There are two types of visa available to you of varying degrees of
success depending on your circumstances.
Settlement Visa or Visit Visa
If you are intending on living permanently in the UK then it is better to follow the route for a settlement visa. Although it is more complicated, the settlement visa route is usually more successful because it is easier to prove that your partner is genuine and that you "intend to live permanently as husband and wife" rather than the potentially impossible task of proving that your partner will leave the UK on expiry of the visa. The evidence required for a visit visa will be:-
1) Proof of suitable accommodation. 2) Invitation from Sponsor. 3) Proof of sufficient money to pay for your ticket and all other travel expenses. 4) Reason for visit ( holiday ) 5) Proof of property ownership in Thailand ( helps substantiate the "reason to return"). 6) Letter from your partner's employer in Thailand allowing time off for the period required. ( helps substantiate the "reason to return").
Although paragraph 4 and 5 are optional, the chance of success without at least one of them is significantly reduced. More details about Visa Requirements can be found in Forms INF1 (General Information) and INF2 (Information for Visitors) from UK visas, a government controlled organisation of the Foreign and Commonwealth Office and the Home Office. You will need to adobe reader installed in your pc as these files are in PDF format.
The settlement visa consists of two types, marriage or fiancé. A fiancé visa will allow your partner to enter the UK for a period of 6 months. Before the expiry the holder has to get married in the UK and applied for full settlement or return to Thailand. A marriage visa is available for couples married in Thailand and will allow your partner to obtain a FLR settlement visa ( Further Leave to Remain ) This is currently for a period of two years where you are expected to live together as man and wife. You will need to collect evidence during the two years so you obtain the final visa ILR ( Indefinite Leave to Remain ).
To obtain a settlement visa you need to build a evidence folder that includes the following items.
1) Proof of your relationship ( this may include photographs, telephone bills and any evidence that you are a "real couple"
2) Proof that you have adequate accommodation in the UK - this can be either rented accommodation, mortgaged property or living with parents, friends etc.
3) Proof that you have adequate funds to support you both in the UK without claiming state benefits ( if you have been living in Thailand you will need to show guaranteed job offers etc )
4) 6 months of bank statements
5) Documents about your partner ( Bank, home, work etc )
Depending on the evidence provided, your partner will be required to attend and interview at the embassy in Bangkok. The waiting time can be anything from 1 week to 12 weeks depending on the embassy workload. If you have provided full evidence at time of application and the embassy are satisfied with it, they may only require a 5 minute interview which is normally conducted within a week of application submission. In more complex applications a full interview will be scheduled. Your partner will be interviewed and is expected to know a lot about you, your family and details of your proposed life in England....it is surprising how many applicants fail because they know little about their partner, his birthday, his home town etc. These interviews are conducted in Thai or English but we recommend that you try to use English as much as possible to prove that there is good communication between the two of you.
Can my Thai partner work in the UK ?
Visitor Visa - NO Fiancé Visa - NO ( until you are married and have NI registration ) Marriage Visa - YES ( but you need to get a NI number )
